2025 - The President of the Atheists in Kenya Society, Harrison Nyende
Mumia, has been charged with multiple counts of false publication under Section
22(1) of the Computer Misuse and Cyber Crime Act No. 5 of 2018.
According to the charge sheet, Mumia allegedly used his
social media platforms - including his personal Instagram account and a
pseudo-Facebook account - to publish false images of President William Ruto.
The prosecution claims that on December 30th,
2025, Mumia, while at an unknown location, disguised himself as “Robinson
Kipruto Ngetich” and posted an image portraying the Head of State lying dead in
bed, despite knowing he was alive.
The charge sheet further states that on the same date, Mumia
published another image of President Ruto appearing critically ill on a
hospital bed, again fully aware the information was false.
Similar posts were allegedly shared through his Instagram
account under the username @harrisonmumia, as well as a fourth account,
repeating the same portrayal of the President as deceased or gravely ill.
Appearing before Milimani Chief Magistrate Dolphina Alego on
Monday, January 5th, 2026, Mumia denied all charges, and a plea of
not guilty was entered.
His lawyer, Levi Munyeri, argued for his release on bond,
insisting that Mumia is not a flight risk and that his residence is well known.
The court granted him a bond of Ksh1 million with one
surety, or an alternative cash bail of Ksh500,000 with two contact persons.
Magistrate Alego directed that the matter be mentioned again on January 19th, 2026.
