2025 - A Kibra court has sentenced a man to death after convicting him on
two counts of robbery with violence from incidents that occurred in Kawangware,
Nairobi, on the night of November 3, 2024.
According to the Office of the Director of Public
Prosecutions (ODPP), the man violently robbed two victims of mobile phones
worth Ksh39,000 and cash amounting to Ksh30,000.
The court heard that the accused snatched a Tecno phone
worth Ksh24,000 from one victim, before threatening another and taking his
phone valued at Ksh15,000.
The prosecution, led by Ann Murage, successfully argued that
the crimes were committed with threats of actual violence, and possibly in
concert with an accomplice who was not charged.
Principal Magistrate Christine Njagi ruled that the charges
were proven beyond a reasonable doubt.
She emphasized that the death penalty remains lawful in
Kenya under Section 296(2) of the Penal Code, even if no lives are lost,
provided violence or threats are used.
The accused received two death sentences, with one held in
abeyance.
The case, formally opened on November 15th, 2024,
was concluded within six months.
